Most People Are Denied — And Most Should Appeal
We handle Social Security Disability appeals with hearings at the Florence and Tuscaloosa offices of the Office of Hearings Operations — the hearing offices that serve Northwest Alabama clients.
After each denial, you have 60 DAYS (plus 5 days for mailing) to file your appeal. Miss this deadline and you generally must start the process over from scratch — losing any back pay you may have accumulated. Call me as soon as you receive a denial notice.
Alabama law gives you two years from the date of injury to file a personal injury lawsuit. Miss that deadline and you lose your right to recover — no exceptions. Don’t wait to call.
The 4-Level Social Security Appeals Process
Initial Application
Filed online, by phone, or at your local SSA office. SSA reviews medical records and work history. Approval rate: approximately 33%.
Reconsideration
A different SSA reviewer examines your case. Very few cases are approved at this stage — it's largely a required step before requesting a hearing. Approval rate: approximately 13%.
Administrative Law Judge (ALJ) Hearing
This is where most cases are won. You appear before an Administrative Law Judge in Florence or Tuscaloosa. I represent you at the hearing, present medical evidence, and question the vocational expert. Approval rate with attorney representation: approximately 55%.
Appeals Council + Federal Court
If the ALJ denies your claim, you can appeal to the SSA Appeals Council and ultimately to federal district court. These levels are more complex and less commonly needed, but available when warranted.
How Social Security Evaluates Disability
Are you working?
If you're earning above the Substantial Gainful Activity (SGA) threshold (~$1,550/month in 2024), you're not considered disabled.
Is your condition severe?
Your impairment must significantly limit your ability to do basic work activities for at least 12 months.
Does it meet a Listing?
SSA's "Blue Book" lists specific conditions that automatically qualify. Meeting a Listing means automatic approval.
Can you do past work?
If you can still perform your past relevant work, you're not disabled — even with limitations.
Can you do any work?
SSA considers your age, education, and work experience. Older workers with limited education and physical jobs often qualify here even without meeting a Listing.
